In late February 2010 Jeff Stanger, Brian Groce & Utter Oddcast were sent letters from David Warga of Naked News®.

The gist being that Mr. Warga claims that Utter Oddcast:

1. Is intentionally infringing on Naked News’® rights, and conspired to do so, by talking about people who are naked (or semi-naked) in news stories on our segment we refer to as “Naked News”.
2. Is confusing people on the “brand”.
3. Is profiting from the Naked News® name/brand.
4. Is a “pornographic” website.

UTTER ODDCAST’S REBUTTAL

1. We are taken aback by this and have no idea how the accusations came to fruition. We vehemently deny these allegations.
2. We seriously doubt that anyone would confuse Utter Oddcast with the pornographic “news” site/service known as Naked News®.  If they are, this is completely unintentional and is not desired.
3. While we’re not opposed to it, we DO NOT currently make money off of this podcast.
4. We believe that this statement may fall under defamation.  There aren’t even photos on our website, let alone pornographic photos and/or videos.  At the very least we’d appreciate an apology from Mr. Warga for insinuating such.
